The Schall Law Firm, a national shareholder rights litigation firm, announces that it is investigating claims on behalf of investors of Vanda Pharmaceuticals Inc. (Vanda or the Company) (NASDAQ: VNDA) for violations of §§10(b) and 20(a) of the Securities Exchange Act of 1934 and Rule 10b-5 promulgated thereunder by the U.S. Securities and Exchange Commission.
The investigation focuses on whether the Company issued false and/or misleading statements and/or failed to disclose information pertinent to investors. Aurelius Value published a report on February 11, 2019, which details a whistleblower lawsuit against Vanda. The Lawsuit alleges that Vanda has engaged in a series of fraudulent schemes, some personally orchestrated by [its CEO], to defraud government payors. The whistleblower states that these schemes involve illegal off-label promotion of both of Vandas drugs, Vandas participation in a fraud involving doctors writing hundreds of ˜fake prescriptions and pocketing cash using Vanda-issued copay cards, falsified documents in internal systems, and resignations of senior executives who refused to participate in illegal activity. Based on this report, Vandas share price dropped significantly the same day.
